TOS: Booking Melissa DiVietri

By booking a live art experience with Melissa DiVietri, professionally known as Blue Eye Queen, you (“Client”) agree to the following terms and conditions:

1. Booking & Payment

All bookings require full payment upfront to reserve the date.

Accepted bookings are confirmed only upon receipt of payment in full.

Any unpaid balances or additional charges incurred under Section 4 must be settled within 30 days of invoice date. Late payments will incur a 10% penalty fee per 30-day period until paid in full.

2. Services Provided

Services include live abstract painting for the agreed duration (1–4 hours), performance tailored to your event theme, and provision of all painting materials.

Travel, lodging, and meals are included in the booking fee unless otherwise specified in writing.

3. Client Responsibilities

Client must ensure that transportation and safe access to and from the venue are available, including accessible entry and setup space.

Client must provide accurate event details, including location, schedule, and access accommodations.

Insurance coverage for the event is required and must include guest artists/performers.

4. Additional Expenses

Any expenses outside the agreed flat fee — including but not limited to lodging changes, unforeseen travel costs, venue access issues, or extended performance requests — will be billed separately to the Client.

5. Cancellations & Refunds

All client cancellations are non-refundable, regardless of notice period.

If the Artist is unable to perform due to illness, emergency, or other unforeseen circumstances, the Client will be issued a full refund or may reschedule the performance, subject to availability.

6. Liability

The Artist is not liable for any injuries, damages, or losses incurred during the event.

The Client assumes full responsibility for event safety, including compliance with all local laws, permits, and venue requirements.

The Artist is not responsible for disruptions or cancellations caused by weather, acts of God, strikes, venue restrictions, or other circumstances beyond her control.

7. Media & Rights

The Artist retains all intellectual property rights to works created during the event.

Clients may photograph or film the performance for personal or promotional use, provided proper credit (“Blue Eye Queen”) is given.

By submitting payment and reserving a booking, the Client acknowledges that they have read, understood, and agree to these Terms of Service.
